Violence against women is a social, economic, developmental, legal, educational, human rights, and health (physical and mental) issue. The United Nations General Assembly resolution endorsed the urgent need for the universal application of women's rights of equality, security, liberty integrity and dignity. Article 55 and 56 of United Nations charter cast a legal obligation on United Nations organization to promote respect for equality and human rights. The Universal Declaration of Human Rights, article 5, states that no one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.

 

In India, the principle of gender equality is enshrined in the Constitution of India. Article 14 provides Right to Equality, Article 21 provides Right to life. In order to uphold and implement the Constitutional Mandate, Ministry of Women and Child Development (MWCD) and Ministry of Home Affairs (MHA) of the Government of India have undertaken a number of measures for enhancing safety of women in the country like Non-lapsable corpus Nirbhaya Fund , ‘One Stop Centre’ for violence affected women, Scheme of ‘Universalisation of Women Helpline’ The Protection of Women from Domestic Violence Act, 2005’, ‘The Dowry Prohibition Act, 1961’,The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013’ etc.

Violence against Women

Despite so many laws in place, Crimes against women are increasing. According to the NCRB report,2019, a total of 4,05, 861 cases of crime against women were registered during 2019 and majority of the cases were caused due to cruelty by husband or his relatives’ (30.9 per cent), and as per the horrifying statistics, every 16 minutes, a woman is raped somewhere in India.

 

The main reasons for violence against women may be considered as patriarchal mindset of society, sociodemographic factors, sociocultural factors, Inefficient grievance redressal mechanism, delayed justice and lack of proper implementation of government policies.

 

For prevention and prohibition of violence against women, Control on media by censoring the Sexual material and Ban on pornography should be strictly implemented. Efficient and accountable law enforcement machinery at all levels (administration, government, police and judiciary) is needed. Fast track courts for rape cases, fast delivery of justice in cases related to violence against women is the need of the hour. 

Initiatives taken by Government of India

Proper rehabilitation of the victim by granting “Interim Relief”. Code of conduct at work place, school and home, with respect to interaction with persons of opposite sex should be outlined and implemented. Gender sensitization by parents and teachers is needed regarding the sensitivities and boundaries of man-woman relationships. Equal opportunity should be given to women for education and employment. Parents and teachers should strive to infuse good moral and religious values in children and serve as role model along with strict implementation of law.
